You must be at least 18 years of age to access or use this Website. You must be at least 21 years of age to purchase handguns, handgun frames/receivers, pistol ammunition designed exclusively for handguns, suppressors, or any other item federally requiring the purchaser to be 21 years old. You must be at least 18 years of age to purchase long guns (rifles/shotguns) and standard rifle/shotgun ammunition, subject to stricter state/local laws.
By using the Website or placing an order, you represent and warrant that you meet all age, eligibility, and legal requirements under federal, state, and local law, including the Gun Control Act of 1968 (as amended), National Firearms Act, and all ATF regulations. We reserve the right to refuse service, cancel orders, or terminate access to anyone who does not meet these requirements or whom we suspect may be ineligible.
All sales are strictly subject to and conditioned upon full compliance with all applicable federal, state, and local laws and regulations, including those enforced by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Winchester Guns & Ammo is a licensed Federal Firearms Licensee (FFL) and conducts business accordingly.
You are solely responsible for knowing and complying with all laws regarding the purchase, possession, transfer, shipment, use, and ownership of firearms, ammunition, magazines, accessories, and related items in your jurisdiction. We do not provide legal advice. We may cancel any order if we believe it would violate any law.
You certify that you are the actual purchaser/transferee of any firearm(s) and are not purchasing on behalf of, or as an agent for, any other person (a "straw purchase"). Straw purchases are a federal felony under 18 U.S.C. § 922(a)(6). Any attempt to induce or facilitate a straw purchase will result in immediate order cancellation, reporting to authorities, and potential legal action. You agree not to purchase for any prohibited person under 18 U.S.C. § 922(g) or (n).
No firearm will ship directly to any non-FFL individual. All firearms (including frames/receivers) must transfer to a valid Federal Firearms Licensee (FFL) in your state of residence. It is your responsibility to locate and provide us with a copy of the receiving FFL's license before shipment. The receiving FFL will conduct the required background check (NICS), have you complete ATF Form 4473, verify your identity, and handle the transfer.
All firearm sales are conditional and contingent upon: successful NICS background check, completion of ATF Form 4473, verification of eligibility, and compliance with all laws. If denied or ineligible, the sale is void. We are not liable for denial reasons.
You are strongly encouraged to thoroughly inspect any firearm prior to completing the transfer at the receiving FFL. Once the transfer is complete, the firearm is considered used, and our return policies apply strictly.
Suppressors, short-barreled rifles/shotguns, machine guns, etc., require ATF approval, $200 tax stamp, Form 4 (or Form 1), and additional compliance. These items are subject to separate terms and federal waiting periods. Contact us for details.
Firearms (New and Used): All firearm sales are final once transferred by an FFL. No returns or exchanges except for manufacturer defects covered under the manufacturer's warranty. Used firearms are sold strictly "AS IS" with no warranty, express or implied, and no returns for any reason.
Unused / Unopened Accessories (Non-Firearm): Returns accepted within 30 days if unused, in original packaging, with proof of purchase. Subject to 20% restocking fee. Return shipping and insurance are your responsibility. No credit/refund for shipping fees originally paid.
Used Merchandise / Accessories: Sold "AS IS" – no returns or exchanges.
Ammunition: All ammunition sales are final. No returns, exchanges, or refunds for any reason (including incorrect caliber, quantity, or change of mind), due to safety and legal considerations.
Manufacturer Warranty for New Firearms: Any damage/defect issues must be handled directly through the manufacturer's warranty process. We do not accept returns for warranty claims.
All returns require prior written approval (RMA). Unauthorized returns may be refused or incur additional fees. We reserve the right to charge cancellation fees up to 15% for any order changes or cancellations after placement.
We strive for accuracy but do not warrant that descriptions, images, pricing, or availability are error-free. We reserve the right to correct errors, cancel orders (including after confirmation), or limit quantities without liability. Prices and availability subject to change without notice. In the event of pricing errors or inventory discrepancies, we may refuse or cancel orders without any charge to you.
We will not sell to any prohibited person under federal law (felons, fugitives, unlawful drug users, adjudicated mentally defective, etc.). If denied by NICS or otherwise ineligible, no sale occurs. We may retain deposits/fees to cover costs.
To the fullest extent permitted by law, Winchester Guns & Ammo, its owners, employees, affiliates, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from Website use, product purchase/use, or any transaction. This includes (without limitation) injury, death, property damage, loss of profits, or data, even if advised of the possibility. Our total liability shall not exceed the purchase price paid. We are not liable for any misuse of products, including unsafe handling or improper storage, nor for any third-party actions or content.
All products are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, except manufacturer warranties where applicable. Used items carry no warranties. We make no representations that the Website is free from errors, viruses, or interruptions, and your use is at your sole risk.
You agree to indemnify, defend, and hold harmless Winchester Guns & Ammo and its affiliates from any claims, losses, damages, liabilities, costs (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of products, or breach of any law.
You agree not to: violate laws; attempt unauthorized access; interfere with the Website; use bots/scrapers without consent; or engage in fraudulent activity. We may terminate access immediately for violations.
All content (text, images, logos) is our property or licensed to us and protected by law. No reproduction or commercial use without written permission. You may not create derivative works, frame the site, or use our trademarks without express consent.
These Terms are governed by Kentucky law (without regard to conflicts of law). Any disputes shall be resolved exclusively by binding arbitration in Winchester, Kentucky, under American Arbitration Association rules. You waive jury trial and class actions.
